The African Democratic Congress (ADC) has criticized the Economic and Financial Crimes Commission (EFCC) for revoking the administrative bail granted to former Attorney-General of the Federation (AGF), Mallam Abubakar Malami (SAN), describing the action as politically motivated.
Malami, is currently under investigation by the EFCC for alleged financial impropriety, including money laundering and abuse of office, and was initially granted provisional administrative bail.
In a statement signed by the National Publicity Secretary of the party, Mallam Bolaji Abdullahi, the ADC claimed that Malami did not violate any of the legal conditions attached to his initial bail. The party argued that the decision of the EFCC to revoke his bail immediately after Malami attended a political rally in his home state of Kebbi created the impression that the action was intended to curtail his political activities and cripple his gubernatorial ambition in the state.
The ADC warned that using investigations against opposition figures or those outside the circle of power weaponizes the fight against corruption, undermining genuine anti-corruption flush out.
The ADC argues that the actions of the EFCC give the impression that the agency is a gladiator in the political arena rather than an impartial body, which could erode public trust in anti-corruption flush out. The party demanded Malami’s immediate release on bail without conditions that prevent his political rights.
Meanwhile, the EFCC dismissed the claims of the party, stating that the former AGF’s administrative bail was never revoked. The EFCC insisted that Malami was detained because he failed to meet the five specific conditions of the provisional bail he was granted on November 28, 2025.
The EFCC also stated that Malami was due for further interrogation on December 1, but wrote a letter pleading for an adjournment on grounds of ill-health. The EFCC stated that while the plea was granted, Malami neither submitted a medical report nor credible proof of his ill-health. The Commission advised Malami to focus his energy on meeting his outstanding bail conditions and cooperating with the investigation.
